Terms of Service

1. Parties and acceptance

Vrex Visual (the “Service”) is provided by Vixel AS, Storgata 9, 2815 Gjøvik, Norway, org. nr. NO 914 457 726 (“Vixel”). Contact: admin@vixel.no.

These Terms form an agreement between Vixel and the organization on whose behalf the Service is used (the “Customer”). By creating an account or using the Service, the Customer accepts these Terms.

2. Scope

These Terms apply to the Service’s self-service plans. Where the Customer has a separate written agreement with Vixel — including Enterprise and VrexPro agreements — that agreement governs and prevails over these Terms to the extent they differ.

3. The Service

The Service generates photorealistic images and clips from design material supplied by the Customer (model viewpoints, photographs, renders) and the Customer’s instructions, using AI models operated by Vixel’s providers. Generated output may be imperfect or fail; Vixel does not warrant any particular result.

4. Accounts and organizations

Accounts belong to an organization. Credits, projects and billing are shared within the organization. The Customer is responsible for the accuracy of its account information, for safeguarding sign-in credentials, and for all use of the Service by members of its organization.

The Service is offered to businesses and professionals. By creating an account, the Customer confirms that it uses the Service in the course of business.

6. Payment and cancellation

Payment is processed by Stripe. Subscriptions renew each billing period (monthly or yearly) until cancelled. Cancellation takes effect at the end of the current paid period and stops further renewals and credit grants. Fees for a billing period already commenced are not refundable except where required by law.

7. Customer content

The Customer retains ownership of the material it uploads and of the output generated from it (together, “Content”); the Image Rights policy forms part of these Terms. The Customer grants Vixel a non-exclusive licence to store, process and display Content solely to provide the Service, including processing by the providers Vixel engages to operate it. Vixel processes Content only on the Customer’s instructions.

The Customer is responsible for holding the rights necessary to upload and process its Content and for any personal data it contains. Vixel does not use Content to train or improve AI models and contractually prohibits its providers from doing so. A current list of Vixel’s providers is available on request; Vixel gives notice of changes.

8. Acceptable use

The Customer shall not: (a) upload material it is not entitled to use; (b) generate unlawful content or use the Service to infringe the rights of others; (c) circumvent technical limits, safety measures, credit accounting or tenant isolation; (d) abuse the signup grant; or (e) resell or provide the Service to third parties without Vixel’s written consent. Vixel applies reasonable rate limits and may suspend or terminate accounts in breach of these Terms.

9. Availability and changes

The Service is provided “as is” and without an availability commitment. Vixel may modify the Service; the scope of a paid plan will not be materially reduced during a paid period without notice.

10. Liability

To the extent permitted by Norwegian law, Vixel is not liable for indirect or consequential loss, and Vixel’s aggregate liability is limited to the fees paid by the Customer in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law.

11. Termination

The Customer may delete its account, with its data, in the application at any time; the Privacy Policy describes the effect of deletion. Vixel may suspend or terminate accounts for breach of these Terms, with notice where reasonable.

12. Governing law and venue

These Terms are governed by Norwegian law. Disputes are subject to the Norwegian courts with venue in Gjøvik, without prejudice to mandatory consumer protection in the Customer’s country of residence.

13. Changes to these Terms

Vixel may update these Terms. Material changes are announced to account holders by email or in the application before they take effect.
